The article concerns the topic of religion in Thomas Hobbes' view of man.

In 1792, with the aim of defending Kant's doctrine of freedom, Reinhold redefined freedom of will as the ability to decide for or against the moral law. Thus freedom of will represents a foundation of moral philosophy, if not of philosophy as a whole. The present volume seeks to reinterpret and to discuss this chapter of the post-Kantian discourse on freedom from various perspectives.

An increasing number of transcription factors both from prokaryotic and eukaryotic sources are found to bend the DNA upon binding to their recognition site. Bending can easily be detected by the anomalous electrophoretic behaviour of the DNA‐protein complex or by increased cyclization of DNA fragments containing the protein‐induced bend. Induction of DNA bending by transcription factors could regulate transcription in various ways. Bending may bring distantly bound transcription factors closer together by facilitating DNA‐looping or it could mediate the (...) interaction between transcription factors and the general transcription machinery by formation of large nucleoprotein structures in which the DNA is wrapped around the protein complex. Alternatively, the energy stored in a protein‐induced bend could be used to favour formation of an open transcription complex or to dissociate the RNA polymerase in the transition from initiation to elongation. Modification of the bend angles and bending centers, caused by homodimerization or heterodimerization of transcription factors, may well turn out to be an important way to enlarge the range of interactions required for regulation of gene expression. Lying in the sense of declaring as true what you believe to be false takes a special position within ethical discourse concerning truthfulness and the virtues and vices of communication. None of the many other ways in which people lack truthfulness is considered nearly as vicious as lying. However, in everyday life our attitude towards lying is far from consistent insofar as we tend to take both an absolutist and a relativist position towards lying. The article shows that our inconsistency (...) derives from several philosophical traditions which have developed widely different concepts and moral attitudes with regard to lying. And with respect to the challenges of present life it is argued that instead of bending all our thoughts on lying, we should rather follow Michel Foucault and Bernard Williams in distinguishing the virtues of veracity we should cultivate in the different areas of modern life. Jeg diskuterer i denne artikel en række principielle spørgsmål angående det der kaldes «religionens genkomst» i det moderne demokrati. Mit hovedeksempel er den såkaldte «Muhammed-krise», som stadigvæk debatte­res med stor intensitet i nationale og internationale sammenhænge. De tre hovedspørg­smål lyder: Hvilken plads kan religiøse synspunkter og ytringer gøre krav på i den demokratiske offentlighed? Kan vi indholdsmæssigt fastsætte grænsen for religiøs blasfemi ved lov eller står den til løbende demokratisk debat? I hvilken grad kan reli­giøse minoritetsgrupper kræve anerkendelse fra – (...) og beskyttelse mod – majoritetskultu­ren i moderne, liberale demokratier? Til det første spørgsmål svarer jeg med Jürgen Habermas at religiøse grupper bør forsøge at oversætte deres holdninger til ikke-religiøse argumenter, samtidig med at denne oversættelse af forskellige årsager ikke kan fremtvin­ges retsligt eller afkræves som betingelse for demokratisk deltagelse. Mht. til det andet spørgsmål argumenterer jeg – igen med Habermas – for, at den konkrete anvendelse af abstrakte retsprincipper som ytringsfrihed og religionsfrihed kræver åben, demokratisk debat med bred deltagelse for athave legitimitet. Resultatet af denne debat kan godtvære et strengt syn på, hvad der tæller som blasfemisk, men muligheden for at kritisere dette syn – eller for generel religionskritik – kan ikke undertrykkesuden at gå kompromis med det liberale demokratis grundprincipper. Som svar på det tredje spørgsmål, og som et kritisk supplement til Habermas, fremfører jeg med Axel Honneth, at samfundsmæssig integration ikke skabes af demokratiske debatter alene. Der kræves også en vis før-dis­kursiv atmosfære af solidaritet: Religiøse minoritetsgrupper kan ganske vist ikke kræve juridisk beskyttelse af religiøse følelser, men de kan påpege «asymmetriske anerkendel­sesforhold», f.eks. ensidigt negative fremstillinger i medierne, som forringer deres mulighed for at bidrage til samfundet som anerkendte og anerkendende medborgere. The conception of the doctor–patient relationship under Australian law has followed British common law tradition whereby the relationship is founded in a contractual exchange. By contrast, this article presents a rationale and framework for an alternative model—a “Trust Model”—for implementation into law to more accurately reflect the contemporary therapeutic dynamic. The framework has four elements: an assumption that professional conflicts with patient safety, motivated by financial or personal interests, should be avoided; an onus on doctors to disclose these conflicts; a (...) proposed mechanism to contend with instances where doctors choose not to disclose; and sanctions for non-compliance with the regime. The role of the Home Office in the Peterloo Massacre remains contentious. This article assesses the available evidence from the Home Office and the private correspondence of Home Secretary Viscount Sidmouth to contest E. P. Thompson’s claim that the Home Office ‘assented’ to the arrest of Henry Hunt at St Peter’s Fields. Peterloo is placed within the context of government’s response to political radicalism to show how the Tory ministry had no clear counter-radical strategy in the months leading up to (...) the August event. The article further argues that although the Home Office may not have assented to forceful intervention on the day, the event and its aftermath were needed to justify the Six Acts which would ultimately cripple the reform movement. The novel COVID-19 infection has spread all over the world and is still generating a lot of issues at different levels. There is a lack of control in disease early diagnosis and rapid evolution, which impacts both the medical and the economic system. Young gastroenterologists should adapt to overcome current difficulties and continue their life and general training. This is a multi-center national study, which aims to assess the general perspective of young gastroenterologists from six university centers in Romania regarding (...) their current training and the psychological effect the pandemic has on their life and job. An online survey with 58 items was distributed using Google Forms, and quality of life and anxiety were assessed. The validated instruments 15D and endler multidimensional anxiety scales were used. All analyses were performed using SPSS 25. Of the 174 gastroenterologists approached, 96 responded. A majority of the respondents were residents in gastroenterology, and 40.6% were male. The pandemic influenced the number of examined patients as well as young gastroenterologists’ endoscopy training. Health-related quality of life was negatively associated with the level of anxiety generated by the cognitive component of anxiety as a state, the new and ambiguity of the state, and how threatened the respondent felt. The level of anxiety was moderate, and no difference was found between the physicians working in a designated hospital or not. General caution should be considered for young gastroenterologists’ training, and continuous observation should be done to ensure better mental health on the current evolution. These findings would need to be verified in larger-sample studies and in different types of specialties. (shrink)

Kant argues that morals should not only constrain politics, but that morals and politics properly understood cannot conflict. Such an uncompromising stance on the relation of morals to politics has been branded unrealistic and even politically irresponsible. While justice can afford to be blind, politics must keep its eyes wide open. In response to this charge I argue that Kant’s position on the relation of morals to politics is both morally uncompromising and yet politically flexible, both principled and practical. Kantian (...) justice is not blind to circumstances, and we need not abandon our convictions in order to be politically responsible. Indeed, Kant argues that future political progress can only be achieved when the coerced rule of right is coupled with the non-coerced rule of virtue. For Kant, freedom and justice are intertwined with publicity, and publicity depends upon the critical acumen and moral candour of an enlightened and virtuous citizenry. (shrink)

The goal of the book is to present the latest research on the new challenges of data technologies. It will offer an overview of the social, ethical and legal problems posed by group profiling, big data and predictive analysis and of the different approaches and methods that can be used to address them. In doing so, it will help the reader to gain a better grasp of the ethical and legal conundrums posed by group profiling. The volume first maps the (...) current and emerging uses of new data technologies and clarifies the promises and dangers of group profiling in real life situations. It then balances this with an analysis of how far the current legal paradigm grants group rights to privacy and data protection, and discusses possible routes to addressing these problems. The dead donor rule—that persons must be dead before their organs are taken—is a central part of the moral framework underlying organ procurement. Efforts to increase the pool of transplantable organs have been forced either to redefine death (e.g., anencephaly) or take advantage of ambiguities in the current definition of death (e.g., the Pittsburgh protocol). Society's growing acceptance of circumstances in which health care professionals can hasten a patient's death also may weaken the symbolic importance of the dead donor rule. (...) We consider the implications of these efforts to continually revise the line between life and death and ask whether it would be preferable to abandon the dead donor rule and rely entirely on informed consent as a safeguard against abuse. In this paper a corporate social responsibility audit is developed following the underlying methodology of the quality award/excellence models. Firstly the extent to which the quality awards already incorporate the development of social responsibility is examined by looking at the Malcolm Baldrige National Quality Award and the European Quality Award. It will be shown that the quality awards do not yet include ethical aspects in relation to social responsibility. Both a clear definition of social responsibility and an improved audit instrument (...) are required. A definition and an audit instrument are developed which stimulate movement in that direction and help organisations to reflect on their position in relation to social responsibility. (shrink)

This study argues for three main theses: (1) Immanuel Kant’s ethics is a social ethics; (2) the basic premises of his social ethics point to a socialist ethics; and (3) this socialist ethics constitutes a suitable platform for criticizing and improving Karl Marx’s view of morality. -/- Some crucial aspects of Kant’s social ethics are that we must promote the “realm of ends” as a moral society of co-legislators who assist each other in the pursuit of their individual ends, which (...) requires in turn that we seek the realization of the republican state and peace between the nations. Thus, hope for progress, as supported by the enthusiasm engendered among the spectators of the French Revolution, becomes pivotal to Kant’s ethics as well as other moral feelings such as moral indignation and solidarity with the victims of oppression. -/- Kant views the moral society in the final instance as an “inner” unification of good wills. In a decisive elaboration of Kant, the neo-Kantian Hermann Cohen argues that all our social institutions, and notably economic enterprises, must instantiate the “realm of ends,” leading him to support cooperative socialism in Wilhelmine Germany. In his own words, Kant “is the true and real originator of German socialism” (1896). -/- There are important evaluative similarities between Kantian socialist ethics and Marx, such as a condemnation of capitalism as a system of servitude and an understanding of the ideal society as a cooperative society, but only Marx contends that the ideal society does not set a moral task and that there is a dialectic operative in human history that inevitably leads to communist society. This dogmatic Hegelian understanding of history must be replaced by Kantian regulative understanding of progress in support of revolutionary praxis as moral praxis. -/- We need a “Kantianization” of Marx, as Cohen and other neo-Kantian socialists also proclaimed in the three decades leading up to World War I. This study concludes with “A Historical Note on Kantian Ethical Socialism,” addressing, among others, Cohen, Karl Vorländer, Eduard Bernstein, and Kurt Eisner and the Munich Revolution of 1918. ABSTRACT:Profit maximizers have reasons to agree with stakeholder theorists that managers may need to consider different values simultaneously in decision making. However, it remains unclear how maximizing a single value can be reconciled with simultaneously considering different values. A solution can neither be found in substantive normative philosophical theories, nor in postulating the maximization of profit. Managers make sense of the values in a situation by means of the many thick value concepts of ordinary language. Thick evaluation involves the simultaneous (...) consideration of different values: making sense of a value always involves knowing how to engage with it given the other values in the situation. This also goes for profit: maximization is only one way of engaging with the value of profit, and grasping whether maximization is appropriate involves considering other values. We discuss some consequences of our approach for stakeholder theorists and profit maximizers. (shrink)

The label ‘Translational Research’ (TR) has become ever more popular in the biomedical domain in recent years. It is usually presented as an attempt to bridge a supposed gap between knowledge produced at the lab bench and its use at the clinical bedside. This is claimed to help society harvest the benefits of its investments in scientific research. The rhetorical as well as moral force of the label TR obscure, however, that it is actually used in very different ways. In (...) this paper, we analyse the scientific discourse on TR, with the aim to disentangle and critically evaluate the different meanings of the label. We start with a brief reconstruction of the history of the concept. Subsequently, we unravel how the label is actually used in a sample of scientific publications on TR and examine the presuppositions implied by different views of TR. We argue that it is useful to distinguish different views of TR on the basis of three dimensions, related to (1) the construction of the ‘translational gap’; (2) the model of the translational process; and (3) the cause of the perceived translational gap. We conclude that the motive to make society benefit from its investments in biomedical science may be laudable, but that it is doubtful whether the dominant views of TR will contribute to this end. This article reports on a survey of the moral problems that Dutch nurses experience during their everyday practice. A questionnaire was developed, based on published literature, panel discussions, in-depth interviews and participation observations. The instrument was tested in a pilot study and proved to be useful. A total of 2122 questionnaires were sent to 91 institutions in seven different health care settings. The results showed that nurses were not experiencing important societal issues such as abortion and euthanasia as morally the (...) most problematic, but rather situations such as verbally aggressive behaviour of colleagues towards patients, keeping silent about errors, and medical treatment given against the wishes of patients. Moral problems occurred especially when nurses experienced feelings of powerlessness with regard to the well-being of patients. Moreover, these moral problems proved to be related to institutional organization, leadership, and collaboration with colleagues and other disciplines. Nurses appeared to have a limited awareness of the moral dimensions of their practice. (shrink)

The notion of cognitive act is of importance for an epistemology that is apt for constructive type theory, and for epistemology in general. Instead of taking knowledge attributions as the primary use of the verb 'to know' that needs to be given an account of, and understanding a first-person knowledge claim as a special case of knowledge attribution, the account of knowledge that is given here understands first-person knowledge claims as the primary use of the verb 'to know'. This means (...) that a cognitive act is an act that counts as cognitive from a first-person point of view. The method of linguistic phenomenology is used to explain or elucidate our epistemic notions. One of the advantages of the theory is that an answer can be given to some of the problems in modern epistemology, such as the Gettier problem. (shrink)

During the past decennium, one of the main issues discussed in research ethics has been focused on the care that should be provided to the control group in a clinical trial. This discussion is also called the standard of care debate . Current international research ethics guidelines contain a wide variety of standards for the standard of care—including the provision of the highest attainable, the best available, the best current, a proven , and an established effective treatment. In this article, (...) we systematically review the currently used standards and argue that none of the current standards is adequate to serve as a universal standard for the standard of care. Alex London has made a substantial proposal for a universal standard, but universally adopting his standard is problematic. In this article, we propose a revised version of London's standard. Four experiments examined the strategies that individuals develop in sentential reasoning. They led to the discovery of five different strategies. According to the theory proposed in the paper, each of the strategies depends on component tactics, which all normal adults possess, and which are based on mental models. Reasoners vary their use of tactics in ways that are not deterministic. This variation leads different individuals to assemble different strategies, which include the construction of incremental diagram corresponding to mental models, and (...) the pursuit of the consequences of a single model step by step. Moreover, the difficulty of a problem (i.e. the number of mental models required by the premises) predisposes reasoners towards certain strategies. Likewise, the sentential connectives in the premises also bias reasoners towards certain strategies, e.g., conditional premises tend to elicit reasoning step by step whereas disjunctive premises tend to elicit incremental diagrams. Someone asked ‘What time is it?’ when her watch reads 3:08 is likely to answer ‘It is 3:10.’ We argue that a fundamental factor that explains such rounding is a psychological disposition to give an answer that, while not necessarily strictly truthful or accurate, is an optimally relevant one (in the sense of relevance theory) i.e. an answer from which hearers can derive the consequences they care about with minimal effort. A rounded answer is easier to process and may carry (...) the same consequences as one that is accurate to the minute. Hence rounding is often a way of optimising relevance. Three simple experiments give support and greater precision to the view that relevance is more important than strict truthfulness in verbal communication. (shrink)

The vulnerability of older hospital patients is increasingly understood in physical terms, often referred to as frailty. This reduces their vulnerability to the functioning body regardless of the psycho-socio-cultural context they are in, and it ignores the role of the hospital environment. This paper starts from a care ethical perspective on care and uses insights from empirical work that shows that hospitalization of older patients is characterized by experiences of uncertainty that give rise to feelings of vulnerability. This paper presents (...) a model that clarifies how vulnerability occurs in the interplay between the embodied subject, others, daily life and the hospital, and shows its dynamic and relational nature. Our complementary perspective of vulnerability is vital for nursing practice in that it starts from the situatedness of the older patient and not only points at what is missing but also at what is of significance to the older patient. Taking into account this perspective helps improving relational care. (shrink)

The Rawlsian conception of constituent power in Alessandro Ferrara’s Sovereignty Across Generations is burdened by a deep contradiction that renders the central argument in the book highly questionable. On the one hand, Rawls is (correctly in my view) presented as the thinker that confronted contemporary political theory with the problem of divisive pluralism. On the other hand, Rawls is also presented (incorrectly in my view) as the thinker who then suddenly found a solution for this divisive pluralism in the ‘common (...) values’ that all the members of these divisively pluralist societies share ‘unproblematically’. The combination of these two moves leaves one with the sense that Rawls rather frivolously put up the problem of divisive pluralism like a strawman that he could shoot down again without much ado. This article proposes a different reading of Rawls that considers him a serious thinker who did not amuse himself and his readers with strawman-problems. For this reading of Rawls, guidance is drawn from Hans Kelsen, the very thinker whom Sovereignty Across Generations casually dismisses for failing to grasp or appreciate the ‘common values’ that pluralist societies share so ‘unproblematically’. To understand pre-Fregean theories of judgment and proposition, such as those found in Locke and the Port-Royal logic, it is important to distinguish between propositions in the modern sense and propositions in the pre-Fregean sense. By making this distinction it becomes clear that these pre-Fregean theories cannot be meant to solve the propositional attitude problem. Notwithstanding this fact, Locke and Arnauld are able to make a distinction between asserted and unasserted propositions (in their sense). The way Locke makes this distinction (...) turns out to be very different from the way it is made by Arnauld. (shrink)
